You must be at least 16 years old to use The Early Bird. By using the Service, you represent that you meet this requirement and have the authority to enter into these Terms on behalf of yourself or the business you represent.

You are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at info@a2mtechnologies.com.

Account owners who add team members are responsible for ensuring those team members are authorized to use the Service and that any employee data entered is accurate and provided with appropriate consent.

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is harmful, abusive, or violates the rights of others
• Attempt to gain unauthorized access to other accounts or our systems
• Reverse-engineer, decompile, or disassemble the Service
• Use automated tools to scrape or collect data from the Service
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these Terms.

You retain ownership of all content you upload to The Early Bird, including photos, videos, messages, form data, and other materials ("Your Content"). By uploading content, you grant us a limited license to store, process, display, and transmit Your Content solely to provide and improve the Service.

You are responsible for ensuring you have the right to upload any content you add to the Service. We do not claim ownership of Your Content.

The Early Bird uses artificial intelligence to analyze photos, generate captions, and assist with form creation. AI-generated content (such as photo tags, captions, and safety observations) is provided for convenience and informational purposes only.

AI outputs are not professional advice. AI-generated safety observations do not replace qualified safety inspections, and AI-generated photo descriptions may contain inaccuracies. You are responsible for reviewing and verifying any AI-generated content before relying on it.

The Early Bird provides tools for tracking work hours and generating payroll reports. These tools are provided for your convenience. You are responsible for verifying the accuracy of all time records and payroll calculations before using them for actual payroll processing. The Early Bird is not a payroll processor and does not handle tax withholding, direct deposits, or tax filings.

We strive to keep The Early Bird available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

The Early Bird offers paid subscription plans. If you subscribe to a paid plan, you agree to pay the applicable fees. We will notify you in advance of any pricing changes. Failure to pay may result in suspension of your account.

Subscriptions. Paid plans are billed as recurring subscriptions on a monthly or annual basis. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

Apple In-App Purchases. If you subscribe through the iOS app, payment is processed by Apple. Your Apple ID account will be charged upon confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID account settings. No refunds will be granted for the unused portion of a subscription period.

The Service, including its design, code, logos, and documentation, is owned by A2M Technologies, LLCand protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology beyond what is necessary to use the Service.

You may delete your account at any time from the Settings screen. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.

Upon termination, your right to use the Service ends immediately. We will handle your data as described in our Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or available at all times. We do not warrant the accuracy of AI-generated content, payroll calculations, or any other data generated by the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A2M Technologies, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify and hold harmless A2M Technologies, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Bexar County, Texas.

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of The Early Bird after changes take effect means you accept the updated Terms.
